Case Brief: Court Martial: Inappropriate Behaviour – Soldier X, Soldier Y and Soldier Z

The Court Martial has fined Soldier X for pulling an Afghan boy’s hand towards his crotch.

The Court Martial has fined Soldier Y and has reduced Soldier Y to the ranks for racially abusing an Afghan man.

The Judge stressed that “any conduct which may affect the success of this aspect of the army’s duty in Afghanistan must be treated seriously….” and reminded the soldiers: “You were well aware of the need to respect local customs and culture and you knew that any behaviour which could be interpreted as having a sexual connotation, or a racist connotation, could well cause very significant and, I stress the word, understandable offence to the local community.”
