Case Brief: EWHC ([2013] EWHC 1418 (Fam)): Assisted Reproduction – E & F

The Court ruled that as the clinic 

– did not provide sufficient information to both parties to enable them to make informed decisions about parentage issues at the time of the treatment,

– did not provide the parties with an opportunity to receive proper counselling about the step proposed prior to treatment, and

– did not keep the records properly,

the legal requirements under the Human Fertilisation and Embryology Act 2008 were not complied with and thus the individual could not be deemed to be a parent of the children.
